By accessing or using CallWaiting.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms. If you do not agree, do not use the Service.
CallWaiting.ai provides AI-powered phone answering, call routing, appointment scheduling, SMS follow-up, and call analytics for local businesses. The Service uses artificial intelligence and large language models to handle inbound calls on your behalf.
CallWaiting.ai is not a licensed answering service bureau and does not provide human operators. The AI receptionist is designed for general business use cases including restaurants and hospitality, salons and spas, and automotive dealerships.
The Service is designed for inbound call handling only. CallWaiting.ai does not make outbound calls on your behalf.
You must create an account to use the Service. You agree to provide accurate, complete, and current information during registration and to keep this information updated. You must be at least 18 years old to create an account.
You are responsible for all activity that occurs under your account. You must notify us immediately at hello@callwaiting.ai if you suspect unauthorized access to your account.
We may offer a free trial period for new accounts. During the free trial:
Current plans (per location, billed monthly):
Starter: $99/month - up to 250 calls per month.
Standard: $149/month - up to 500 calls per month.
Pro: $299/month - unlimited calls per month, includes SMS follow-ups.
Enterprise: Custom pricing - contact us for volume and multi-location plans.
YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD AT THE THEN-CURRENT RATE UNLESS YOU CANCEL BEFORE THE RENEWAL DATE. You may cancel at any time from your account dashboard or by contacting hello@callwaiting.ai. Cancellation takes effect at the end of your current billing period. You will not be charged for the next billing period after cancellation.
Each plan includes a monthly call allowance. If your account reaches its monthly call limit, additional calls will be forwarded to your backup number or voicemail. No overage fees will be charged. We will notify you when you approach your monthly limit so you can upgrade your plan if needed.
All fees are billed in U.S. dollars. Payments are processed by Stripe on behalf of Click Refresh Inc. Past due invoices may be subject to late fees of the lesser of 1.5% per month or the maximum amount permitted by law.
If you are dissatisfied with the Service, you may request a refund within 14 days of your first paid subscription charge. Refund requests after 14 days will be considered on a case-by-case basis. To request a refund, contact hello@callwaiting.ai. Refunds are processed to the original payment method within 10 business days.
We reserve the right to change pricing with 30 days' written notice. Price changes will take effect at the start of your next billing period following the notice.
You agree not to use the Service to:
The CallWaiting.ai receptionist includes a mandatory disclosure at the beginning of each call informing callers that they are speaking with an AI assistant and that the call may be recorded. This disclosure cannot be disabled.
You are additionally responsible for complying with all applicable call recording laws in your jurisdiction, including state wiretapping statutes and the Electronic Communications Privacy Act (ECPA). Many states, including California, require all-party consent for call recording.
By enabling additional call recording features beyond the default AI interaction, you agree to implement appropriate caller disclosures and to indemnify Click Refresh Inc. for any claims arising from your failure to comply with applicable recording laws.
The Service uses AI technology that may make errors, misunderstand callers, or provide inaccurate information. You acknowledge that:
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
CallWaiting.ai may be used by businesses in the legal and financial services industries to handle general inbound call management. However, the following restrictions apply:
CallWaiting.ai's AI receptionist is not a secure or privileged communication channel. Attorney-client privilege does not extend to communications captured, transcribed, or routed through CallWaiting.ai. Law firms and legal service providers must not use the Service to receive confidential client communications or privileged legal advice. Callers should be directed to a human attorney for any privileged matter.
Businesses subject to SEC, FINRA, CFPB, or other financial services regulations (including registered investment advisers, broker-dealers, and licensed lenders) are responsible for ensuring their use of CallWaiting.ai complies with applicable recordkeeping, supervision, and communications rules. CallWaiting.ai does not provide compliance monitoring, suitability screening, or supervisory review of AI-handled communications. Financial services customers use the Service at their own regulatory risk and must independently assess compliance with applicable law before deployment.
CallWaiting.ai is a call management and routing platform. Nothing in the Service constitutes legal advice, financial advice, investment advice, or professional services of any kind. Callers seeking legal or financial guidance must be directed to a licensed professional.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLICK REFRESH INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
Nothing in this section excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded or limited by applicable law.
You agree to indemnify, defend, and hold harmless Click Refresh Inc. and its officers, directors, employees, agents, and technology partners (including NGX Labs LLC) from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; or (d) any content or scripts you configure in the Service.
CallWaiting.ai and its underlying technology, trademarks, logos, and content are owned by Click Refresh Inc. Nothing in these Terms grants you a license to use our intellectual property other than as necessary to use the Service.
You retain ownership of any content or scripts you provide to configure your AI receptionist.
If you believe that content on the Service infringes your copyright, please send a notice to hello@callwaiting.ai containing: (a) identification of the copyrighted work; (b) identification of the infringing material; (c) your contact information; (d) a statement of good faith belief; and (e) a statement under penalty of perjury that the information is accurate and that you are the copyright owner or authorized agent.
You may cancel your subscription at any time from your account dashboard or by emailing hello@callwaiting.ai. Cancellation takes effect at the end of your current billing period.
We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or fail to pay amounts due.
Upon termination, you may request an export of your data within 30 days. After 60 days following termination, your data will be deleted.
These Terms are governed by the laws of the State of California without regard to conflict of law principles.
Before filing any formal dispute, you agree to contact us at hello@callwaiting.ai and attempt to resolve the dispute informally for at least 30 days.
Any dispute not resolved informally shall be resolved by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association.
You waive any right to participate in a class action, class arbitration, or representative proceeding.
Either party may bring an individual action in small claims court if the claim qualifies.
16.1 Entire Agreement. These Terms, together with the Privacy Policy and any applicable Order Forms, constitute the entire agreement between you and Click Refresh Inc. regarding the Service.
16.2 Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16.3 Waiver. No failure to exercise any right under these Terms shall constitute a waiver of that right.
16.4 Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
16.5 Force Majeure. Neither party shall be liable for any delay or failure to perform due to causes beyond its reasonable control, including natural disasters, pandemics, war, government actions, internet or telecommunications failures, or third-party service outages.
16.6 Survival. Sections 9, 10, 11, 12, 15, and 16 shall survive any termination or expiration of these Terms.
16.7 Notices. We may provide notices to you via email, dashboard notification, or posting on the Service. You may provide notices to us at hello@callwaiting.ai.
We may modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or dashboard notification. Your continued use of the Service after the effective date of updated Terms constitutes acceptance.
